Somersby Apple Month September – October 2023 Promotion

  1. The Organizer

    The Organiser of the Promotion is Carlsberg Marketing Sdn Bhd [198501008089(140534-M)].


  2. Promotion Period

    The Promotion Period is from 1 September 2023 (12:01 am GMT +8) and ends on 31 October 2023 (11:59 pm GMT +8).

  3. Eligibility

    This Promotion is open to all non-Muslim aged 21 years or over residents in Malaysia subject to other criteria set out below, the Carlsberg Standard Terms and Conditions, the terms and conditions of the relevant E-commerce platform, the terms and conditions herein and the relevant laws of Malaysia (collectively referred to as “Terms and Conditions”). Employees of the Organiser, its associate agencies, affiliates, distributors, dealers, sponsors, advertising and Promotion agencies, and members of their immediate families are not eligible to participate in this Promotion.

  6. How to participate in the Promotion
    Step 1 : Purchase any 2 units of Somersby (Participating Products) from participating outlets during the Promotion Period.
    Step 2 : Scan the QR code on the POSM and submit proof of purchase on the Promotion microsite.
    Step 3 : Choose the apple of your choice and answer a question on the microsite. Each apple comes with a prize.
    Step 4 : Validation will be done on daily basis on working days.

    1. Participant(s) is required to register Somersby ID in the microsite during the first time to ease the subsequent login.
    2. Participant(s) may make more than one (1) purchase throughout the Promotion Period under the same account/username.
    3. Participant(s) may submit more than one (1) entries throughout the Promotion Period with different purchase order. Submission per participant is limited to ten (10) entries each day throughout the Promotion Period.
    4. One (1) receipt is only valid for one (1) entry. Eg: If the purchase consist of 4 cans in a single receipt, it is only valid for one (1) entry.
    5. Participants who cancel their order more than three (3) times in participating e-commerce platforms during the Promotion Period will be blacklisted from this Promotion. Organizer reserves the rights to forfeit all prizes claimed from blacklisted ID.
    6. The Organiser shall be entitled to request the original Identity Card or the originals of other supporting documents/materials for verification purposes.
    7. The Organiser reserves the right to disqualify and/or remove any Participants from the Promotion without prior notification or disclosure of information should the Participants be suspected of tampering with their entries or breach the Contest terms and conditions.


  7. Winners, Prizes, and Terms and Conditions of Prizes

    There is a total of sixty eight thousands and eight (68,008) prizes to be won throughout the Promotion Period (“Prize(s)”).

    1. Winners may win more than one (1) Prize from Somersby Apple Month Promotion.
    2. Prizes will be snowballed to the following week if the prizes are not fully redeemed during the Promotion week.
    3. Grand Prize is inclusive of the Vespa Primavera 150S bike. It is excluding On The Road requirements (such as, amongst other, registration fee, road tax, runner fee, Puspakom inspection fee, number plate, processing fee and insurance). All the On the Road cost will be borne by the winner(s).
    4. If the Grand Prize is not fully redeemed after the Promotion Period, all the valid entries will be randomized and winner(s) will be selected using a number generator website. Selected winner(s) will be awarded subject to winner’s answer to the questions.
    5. The Organiser reserves the right to substitute the Prize(s) with a prize of similar value, with or without notice.
    6. The Organiser’s decision on all matters relating to this Promotion shall be final, conclusive, and binding, no further appeal will be entertained. The Organiser is not obligated to give any reasons on any matter in the Promotion.
    7. The Prize(s) is non-refundable, non-transferable, and non-exchangeable for cash credit or any other items. Prize(s) not redeemed within the notified period will be forfeited. The participants’ enrollment into this Promotion will not be valid for any other on-going promotion. The Organizer reserves the right to disqualify the Participants’ enrollment/submission for any other on-going Promotion/Contest with the same purchase order.
    8. The Organizers reserves the right to not award any and/or all Prize(s) on the basis that there are insufficient entries. The Organizer is entitled to only award the Prize(s) to the qualified entries and forfeit the remaining Prize(s).
    9. The Organiser makes no representation, warranty or undertaking whatsoever as to any implied terms or conditions with respect to any Prize.
    10. The Organizer reserves the right to determine the model and colour of the Grand Prize. Liaison of any /or all warranty or specifications pertaining to the Grand Prize is to be forwarded to the relevant manufacturer directly.
    11. The Organizer reserves the right to determine how uncollected or unredeemed Prize(s) are to be dealt with.
    12. ‘As it is’ basis – The Organiser excludes all warranties and liabilities in connection with the Prize(s) to the fullest extent permitted by the law, including but not limited to personal injury, direct loss, indirect loss and consequential losses.
    13. The Organiser and/or the appointed agency(ies) shall determine the style, any fittings, fixtures, packaging, accessories and/or form of the Prize(s), as appropriate. The Winner shall accept the Prize “as is” and the Organiser and/or the appointed agency(ies) shall be under no obligation to entertain any request by the Winner to change any aspect of the Prize(s).
    14. The Organiser makes no representation or warranty whatsoever as to the quality or fitness for purpose or any other implied terms and conditions with respect to the Prize awarded in the Promotion, and the Organiser shall not be held liable for any loss, cost or damage to any person resulting or arising from the Promotion or the Prize or the use of it.
    15. The Organiser shall not be responsible for the quality, merchantability or fitness for any aspect of the Promotion, or any goods and/or services relating to the Promotion.
    16. The Organizer shall not be responsible for any modification, cancellation or delay in any aspect of the Prize caused by any third party which is beyond the control of the Organizer.

  8. Notification of Winners and Redemption of Prizes
    1. Participant(s) will be notified via SMS. The Winners must ensure that the data details provided to the Organiser are true, accurate, current, and complete.
    2. Failure to respond to the Organizer’s message notification/calls or unreachable Winner(s) shall be deemed uninterested and forfeiting the Prize(s).
    3. Once the entry has been verified on daily basis during working day and confirmed thereafter, the Organiser will notify participant(s) on winning status subject to entry(s) validity. For e-commerce submissions, verification will only be done after completion of order. For avoidance of doubt, completed order(s) is as shown under “COMPLETED” status on the app.
    4. For Grand Prize redemption, it will take 14 working days to arrange for prize collection. Winner is required to submit the original winning receipt as proof of purchase during the prize redemption.
    5. For Touch N’ Go e-wallet credit, direct credit will be done within 7 working days based on the contact number submitted.
    6. Participants must ensure the contact number registered in their entry(s) is the registered number on their Touch N’ Go e-wallet. The Organizer shall not be liable if the Touch N’ Go credit is not able to be credited should the contact number be indifferent from the number registered in Touch N’ Go.
    7. The Organizer shall not be liable for any loss, damage or delay that occurs to the Prize(s) during the delivery process by the service provider.
    8. No substitution or transfer of Prize(s) by the Winner is permitted. The Organizer shall not be liable for any additional or incidental costs, taxes, expenses, charges, fees, losses or damage that may arise. The Organizer and its agents and employees shall not be liable for any loss or damage whatsoever suffered (including but not limited to indirect or consequential losses) or personal injury suffered or sustained in connection with or arising from the Prize(s).

    The Organiser reserves the right to withdraw, discontinue or terminate the Promotion at any time at its absolute discretion, without notice or liability to any person.


  9. Privacy Policy

    By participating, the Participant explicitly consents that the Organiser shall store the necessary personal data of the Participant. The Participant is free to revoke his or her consent to the storage of data by sending an email to the Organiser and by doing so, the Participant is withdrawing his or her participation in this Contest. The Organiser will use its best endeavours to keep all personal data stored for the purpose of this Contest strictly confidential.


  10. Additional Terms
    1. The Contest Terms and the Carlsberg Standard Terms and Conditions (collectively referred to as “Terms and Conditions”) shall be binding on all Participants who participate in this Contest. The definitions in the Carlsberg Standard Terms and Conditions shall apply unless otherwise expressly stated in the Contest Terms. In the event of any discrepancies between these terms and conditions and any advertising, Contest, publicity and other materials relating to or in connection with this Contest, the final terms and conditions on Carlsberg’s website shall prevail.
    2. Each Participant agrees that he/she has read and understood these Terms and Conditions and by participating in the Contest, each participant will be deemed to have read, understood and agreed to the Terms and Conditions.
    3. The Organiser is also not responsible for any error, omission, interruption, deletion, defect, delay, failure in operation or transmission, communications line failure, theft or destruction, unauthorized access to, or alteration of, user or member communications, or any problems or technical malfunction of any telephone network or lines, the website, computer online systems, servers or providers, computer equipment, system, apparatus, software, failure of e-mail or receipt of entry on account of technical problems or traffic congestion on the internet and/or telecommunication services.
    4. The Organiser reserves the right to amend the Terms and Conditions without prior notice.
